This Terms and Conditions Document is an Agreement between you, the user (customer) of this site, and CasitaHotels.com. The term "CasitaHotels.com" means the operator of this website, [CasitaHotels.com Inc.]. The Term "Hotel" represents all lodging properties listed on CasitaHotels.com. This agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between the customer and CasitaHotels.com with respect to this site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and CasitaHotels.com with respect to this site.

Before using this web site you must read and agree to these Terms and Conditions. Your use of this website is your acceptance and irrevocable agreement without modification of the terms and conditions contained herein.

General Terms and Conditions:

CasitaHotels.com provides services to you subject to the following terms and conditions that you have agreed to:

  1. CasitaHotels.com only facilitates confirmed Hotel room reservations for Hotels listed on this site. CasitaHotels.com does not own or provide any of the services you may choose to reserve. It is the Hotel´s responsibility to provide you the services you have booked.

  2. The CasitaHotels.com website is owned and operated by CasitaHotels.com. Reservations are confirmed only upon payment of a deposit and/or service charge to CasitaHotels.com.

  3. If you use this website to make a reservation, your reservation is cancelable with your agreement that you fulfill and agree to the terms of cancellation described in this agreement of Terms and Conditions.

  4. In the event you fail to attend at the Hotel where you have made a reservation without following the Cancellation Policy described in these Terms and Conditions, you will be held responsible for any payments as you agreed to when booking such reservation.

  5. Deposits and payments made to CasitaHotels.com to confirm your booking is Non–Refundable, except where noted below.

  6. In the event of errors or disputes, under no circumstances will CasitaHotels.com's liability to you, if any, be greater than the deposit and service charge you paid.

  7. Hotels listed on CasitaHotels.com waive their refund and cancellation policies for rooms booked on CasitaHotels.com. Refund and cancellation policies outlined in this agreement override all hotel refund and cancellation policies.

  8. All fees, room rates, taxes and any other charges are in USD and subject to any currency conversions rates where applicable.

NO UNLAWFUL OR PROHIBITED USE:

As a condition of your use of this website, you agree that you will not use this website for any purpose that is unlawful or prohibited by these terms and conditions. You will not publish, submit or input any false or fraudulent information on this website. Specifically, you may not modify, copy, distribute, transmit, publish, display, license, create derivative works from or sell any product, services, information or software obtained from this web site.

AGE AND RESPONSIBILITY:

You warrant that you are at least 18 years old and possess the legal authority to enter into this agreement and to use this web site in accordance with the Terms and Conditions of this agreement. You agree to be financially responsible for all of your use of this web site as well as for the use of your name and credit card account to pay for hotel room reservations available on this web site.

HOTEL ROOM RESERAVTION TERMS AND CONDITIONS:

The following terms and conditions apply when you use this website to reserve and book a Hotel room using this web site.

  1. Booking a Room Reservation:

    On making a reservation, you shall pay a deposit plus a service charge for confirming your reservation. The deposit and service charge rates are disclosed to you prior to confirming your reservation. You will be responsible to the Hotel directly for payment of the balance of the cost of the Hotel room or rooms and days and nights required. Plus any additional applicable payment of taxes and service fees pursuant to the terms and conditions of trade applied by the Hotel. A refund and cancelation policy stated on this website applies to booking and reservation fees collected on this web site only. Hotel operators may have their own refund and cancellation terms and conditions applicable to balances paid and owing after you have checked in. It is your sole responsibility to be aware of these separate Hotel terms and conditions policies. Your reservation is confirmed once your payment with a credit or debit card or by any other payment means has been accepted by CasitaHotels.com, the operator of this website. A reservation and Hotel room booking is only the first night and equal to all applicable room reservation charges.

  2. Booking Payment and Cancellations:

    CasitaHotels.com provides hotel room booking and reservations services. Your booking payment, consisting of the required deposit for the first night, service charges and taxes you pay at confirmation using this website, is only refundable if you cancel 72 hours prior to your arrival at the Hotel. Refund amounts will not be greater than the deposit amounts paid by you including taxes, and applicable fees. CasitaHotels.com has the right to charge a cancellation fee where applicable. Cancellations must be made using the CasitaHotels.com web site ONLY. Any other means of cancelling your room booking reservation will not be acceptable and you will be charged the full deposit amount. Cancellations after the 72 hour notice period will result in full deposit fees being charged to your credit card or debit account.

  3. Failure to Arrive:

    If you do not cancel your reservation, your failure to arrive (no–show) by the agreed check–in date and/or time will result in the cancellation of your entire reservation. By confirming a reservation with your credit or debit card, you agree that in the event you fail to arrive by your agreed check–in date and/or time, you authorize CasitaHotels.com to charge to your credit or debit card without further reference to you an amount determined by CasitaHotels.com site terms, conditions, and policies applicable to the reservation. Under no circumstances will this amount exceed the amount due to CasitaHotels.com under the original terms of your reservation agreement.

  4. After a Reservation is Confirmed:

    CasitaHotels.com will provide a booking confirmation email. This will be your confirmation receipt. It is your sole responsibility to ensure that any email address you provide is correct, your email system is functional, and that your system will not block or use filtering devices to prevent the delivery of any confirmation email. The reservation ID number included on the confirmation should be quoted in all communications regarding the reservation.

  5. Liability:

    By confirming your reservation, you agree that any liability for losses, damages, additional expenses or any claim whatsoever arising out of or in connection with CasitaHotels.com errors or omission, changes in availability, accommodation, health, injury, weather, strikes, fraud, CasitaHotels.com closings or discontinuance of service, or any other cause shall be borne by you, unless otherwise agreed between you and the CasitaHotels.com. Under no circumstances shall CasitaHotels.com, its owners or affiliates be held responsible for such losses, expenses, claims, or demands for refunds or compensation of any nature.

NO LIABILITY AND INDEMNITY:

THE INFORMATION, PRODUCTS AND SERVICES PUBLISHED ON THE CASITAHOTELS.COM WEB SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION SET FORTH ON THIS WEB SITE. THE RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THIS WEB SITE AT ANY TIME.

All hotels and room reservations available on this website and booked through CasitaHotels.com are made with the hotel room supplier and not with CasitaHotels.com. CasitaHotels.com only facilitates the booking of room reservations, which are private contracts between you and the hotel room supplier. CasitaHotels.com is not a party to the contract between you and the hotel room supplier. CasitaHotels.com has no responsibility or liability to you in respect of the terms of that contract.

Prior to making a reservation, you should ensure that you have reviewed the hotel´s own terms and conditions, if any, and that they are acceptable to you. Following confirmation, in the event of unforeseen circumstances, errors, or misrepresentations on the part of the hotel that result in their inability to provide the services contracted for, CasitaHotels.com, assumes NO liability for payments already made, including the deposit and service charge.

THE HOTEL PROPERTIES AND OTHER SUPPLIERS PROVIDING OTHER SERVICES ARRANGED BY CASITAHOTELS.COM ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF CASITAHOTELS.COM OR ITS AFFILIATES. NEITHER CASITAHOTELS.COM NOR ANY OF ITS OWNERS, DIRECTORS, EMPLOYEES, AFFILIATES OR OTHER REPRESENTATIVES WILL BE LIABLE FOR LOSS OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ANY INFORMATION, PRODUCTS, SERVICES AND/OR THE MATERIALS OFFERED THROUGH THIS WEBSITE, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, INCOME, PROFIT OR OPPORTUNITY, LOSS OF OR DAMAGE TO PROPERTY, PERSONAL INJURIES, CLAIMS OF THIRD PARTIES, OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGES, EVEN IF CASITAHOTELS.COM, ITS AFFILIATES, AND/OR THEIR RESPECTIVE SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES, OR SUCH LOSS OR DAMAGES WERE REASONABLY FORESEEABLE. The listing of any accommodations or travel services in this website is not and should not be taken as a recommendation from CasitaHotels.com or a representation or guarantee that the accommodations services will be suitable for the user's purpose. All information about accommodations listed on CasitaHotels.com by independent third parties, and CasitaHotels.com does not undertake to verify the accuracy, completeness, or suitability of such information. There are many situations in which an advertised or contracted hotel may be unsuitable for the user. Under no circumstances will CasitaHotels.com, its owners or affiliates be liable for losses, damages, or third party claims arising out of or in connection with any fraudulent transactions made through this service. You further agree to submit to the exclusive jurisdiction and venue in the state and federal courts located in the State of Nevada for all disputes, cases and controversies regarding this website, your use of this website, and your relationship with CasitaHotels.com. CasitaHotels.com makes no representation that materials on this website are appropriate or available for use in other locations, and accessing them from territories where the Content is illegal is prohibited. Those who choose to access this website from other locations do so at their own risk and are responsible for compliance with local laws, including laws regarding the transmission of technical data exported from the United States or the country in which you reside.
